6. order process
6.1 The advertising of products on our website constitutes an "invitation to treat" rather than a contractual offer.

7. products
7.1 All products shown on our site are subject to availability. If any product you have ordered is not available, we will contact you to let you know and will refund your payment.
7.2 The images of the products on our site are for illustrative purposes only and your products may vary slightly from those images.
7.3 We may periodically change the products available on our website, and we do not undertake to continue to supply any particular product or type of product.
7.4 We will provide you with information about each product's ingredient and nutritional information. We will also let you know if a product contains any of the following listed ingredients/substances which may affect people with allergies or intolerances:
- 7.4.1 cereals containing gluten and gluten products;
- 7.4.2 milk/lactose;
- 7.4.3 eggs;
- 7.4.4 peanuts;
- 7.4.5 nuts (i.e almond, hazelnut, walnut, cashew, pecan nut, Brazil nut, pistachio nut, macadamia nut and Queensland nut);

This information will also be shown on each product's "ingredients" on our website; our multi packs and selection packs will come with a leaflet containing this information and bags have ingredient and allergen information printed on them.
7.5 As all of our products are prepared in the same environment, we are unable to guarantee that our products are completely free from any of the ingredients/substances listed above.
8. prices
8.1 Our prices are quoted on our website.
8.2 Prices for our products are as quoted on our site and may change from time to time, but changes will not affect any order after we have dispatched the products relating to that order.
8.3 All amounts stated in these terms and conditions or on our website are stated inclusive of VAT.
8.4 Our Website contains a large number of products and it is always possible that, despite our best efforts, some of the products listed may be incorrectly priced. We will normally verify prices as part of our order procedures. If a product's correct price is higher than the price stated on our website we may at our discretion reject your order without liability to you and notify you of such rejection. We are under no obligation to supply products to you at an incorrect (lower) price, even after we have sent you an order confirmation, if the pricing error is obvious and unmistakable and could reasonably have been recognised by you as a pricing error.
8.5 In addition to the price of the products, you may have to pay a delivery charge, which will be notified to you as part of the checkout process and before the order is confirmed.
9. free or discounted offers
9.1 Except where otherwise stated, each discount and credit is available only once to any one person.
9.2 Except where otherwise stated, discounts and credits cannot be used in conjunction with any other offers.

9.4 Only graze vouchers specifying that they can be used on the graze shop are valid for use on the ie.graze.com/collections website.
9.5 graze reserves the right to vary the conditions of use or to withdraw vouchers, discounts and credits at any time.
10. payments
10.1 You must, during the checkout process, pay the prices of the products you order.
10.2 Where payment is made using a credit or debit card, payment services are provided by Checkout Ltd.
10.3 Where the PayPal option is selected, payment services are provided by PayPal.
10.4 Payment is taken for all orders prior to the order being dispatched so please ensure that all details given to us are correct. We cannot accept responsibility for an order being held back as a result of incorrect or invalid payment details being given nor can we accept responsibility if incorrect address details are given and the order sent to an incorrect address.
11. deliveries
11.1 Our policies and procedures relating to the delivery of products are set out in this Section 11.
11.2 Our snacks can only be delivered to addresses within the Republic of Ireland, excluding PO Box addresses.
11.3 We will arrange for the products you purchase to be delivered to the delivery address you specify during the checkout process. We always ship to the exact address details you enter, so make sure to check you've given us the correct information before you place your order. We can't accept liability for late or failed deliveries due to an incorrect address.
11.4 deliveries
Your order will usually be sent via the Standard untracked service. Actual delivery times may vary according to :
- 11.4.1 our stock availability;
- 11.4.2 your delivery address;
- 11.4.3 when you make your selection; and
- 11.4.4 circumstances impacting delivery by the postal services.
- 11.4.5 You will not hold us responsible for any delays, outside our control, which relate to the delivery of boxes.
- 11.4.6 We reserve the right to use alternative delivery methods without prior notification.
- 11.4.7 We will use reasonable endeavours to deliver your products within 7 days following the date of the order confirmation; however, we cannot guarantee delivery by this date.
- 11.4.8 We do guarantee that unless there are exceptional circumstances all deliveries of products will be dispatched within 30 days following the later of receipt of payment and the date of the order confirmation.
- 11.4.9 If your box does not arrive, please let us know on shop.ie@graze.com. Be sure to include your order number from your confirmation email when getting in touch.
- 11.4.10 If your box does not fit through your letterbox and you are out when it is delivered, your postal carrier should leave a card at the address with information about collection or re-delivery. The postage provider will hold the box for 10 days before returning it to us and it is your responsibility to contact them to arrange receipt of the box as soon as you can. Due to the perishable nature of the food, we cannot be held responsible for refunding or replacing the box if this process has not been followed.
- 11.4.11 If you have not received your snacks and have not been left a card to say that the delivery has been attempted, please contact An Post to check whether they have the box. You can find your local delivery office here:http://www.anpost.ie/AnPost/at+your+local+Post+Office.htm. If An Post are not holding the box for you, please contact us by email at shop.ie@graze.com to report the problem. Be sure to include your order number from your confirmation email when getting in touch.
- 11.4.12 A reasonable allowance of time will need to be made for any delivery delays before we are able to take action. Either party may cancel your account with us if it becomes apparent that, due to repeated failure to deliver the box to you, the postal service in your area is too unreliable.
12. cancellation, returns and refunds
12.1 We strive to deliver our snacks to you in perfect condition, however if your snacks arrive damaged or faulty, then we always want to know about it. Please contact our customer services team on shop.ie@graze.com.
- 12.1.1 We retain the right to request a return of any faulty goods by recorded delivery to:

and the product will be inspected. If we request return by recorded delivery then we will pay for the cost of the postage on provision of a copy of the postage receipt to our customer services team by email to shop.ie@graze.com.
- 12.1.2 If the fault is agreed, a full refund will be given for the returned goods. If a refund is agreed then we will refund money using the same method used to make the payment, unless you have expressly agreed otherwise.
- 12.1.3 Nothing in this section affects your legal rights.
12.2 Unfortunately, damaged and faulty products are the only reasons for which we can offer a refund or replacement for our snacks. Due to the perishable nature of our snacks, you do not otherwise have a right to cancel your order or any contract between us and we are not otherwise able to offer refunds or allow for a return of those items, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
12.3 We may cancel a contract under these Terms and Conditions by written notice to you if we are prevented from fulfilling that contract by any event beyond our reasonable control, including without limitation any technical error, any unavailability of raw materials, components or products, or any power failure, industrial dispute affecting any third party, governmental regulations, fire, flood, disaster, riot, terrorist attack or war.
12.4 We reserve the right to terminate or restrict your use of our service, for any or no reason whatsoever. One reason that we may do so is if we believe that you are in breach of any obligation under these Terms and Conditions. If we terminate your use of our service as a result of a breach of any obligation under these Terms and Conditions, such termination would be immediate and may be without notice.
13. warranties and representations
13.1 You warrant and represent to us that:
- 13.1.1 you are legally capable of entering into binding contracts and are at least 18 years of age;
- 13.1.2 you have full authority, power and capacity to agree to these Terms and Conditions;
- 13.1.3 all the information that you provide to us in connection with your order is true, accurate, complete and non-misleading; and
- 13.1.4 you will be able to take delivery of the products in accordance with these Terms and Conditions and our delivery policy set out in clause 11 of these Terms and Conditions.
13.2 We warrant to you that:
- 13.2.1 we have the right to sell the products that you buy;
- 13.2.2 the products we sell to you are sold free from any charge or encumbrance, except as specified in these Terms and Conditions;
- 13.2.3 you shall enjoy quiet possession of the products you buy, except as specified in these Terms and Conditions;
- 13.2.4 the products you buy will correspond to any description published on our website; and
- 13.2.5 the products you buy will be of satisfactory quality.
13.3 All of our warranties and representations relating to the supply of products are set out in these Terms and Conditions. To the maximum extent permitted by applicable law and subject to Section 10.1, all other warranties and representations are expressly excluded.

- 14.1.1 limit or exclude any liability for death or personal injury resulting from negligence;
- 14.1.2 limit or exclude any liability for fraud or fraudulent misrepresentation;
- 14.1.3 limit any liabilities in any way that is not permitted under applicable law; or
- 14.1.4 exclude any liabilities that may not be excluded under applicable law,
and, if you are a consumer, your statutory rights will not be excluded or limited by these Terms and Conditions, except to the extent permitted by law.
14.2 The limitations and exclusions of liability set out in this Section 14 and elsewhere in these Terms and Conditions:
- 14.2.1 are subject to Section 10.1; and
- 14.2.2 govern all liabilities arising under these Terms and Conditions or relating to the subject matter of these Terms and Conditions, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty, except to the extent expressly provided otherwise in these terms and conditions.
14.3 We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.

16.1 We will not be liable to you for any lack of performance, or the unavailability or failure, of this website or our services, or for any failure by us to comply with these Terms and Conditions, where such lack, unavailability or failure arises from any cause reasonably beyond our control

17.1 No breach of any provision of a contract under these Terms and Conditions will be waived except with the express written consent of the party not in breach.
17.2 No waiver of any breach of any provision of a contract under these Terms and Conditions shall be construed as a further or continuing waiver of any breach of that provision or any other provision of that contract.

18.2 If any unlawful and/or unenforceable provision of these Terms and Conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

19.1 A contract under these Terms and Conditions is for our benefit and your benefit, and is not intended to benefit or be enforceable by any third party except where a third party acts as our agent, on our behalf at our request and with our express written consent.
19.2 The exercise of the parties' rights under a contract under these Terms and Conditions is not subject to the consent of any third party.
20. entire agreement
20.1 Subject to Section 10.1, these Terms and Conditions, together with the documents described in section 1.5, shall constitute the entire agreement between you and us in relation to the sale and purchase of our products and shall supersede all previous agreements between you and us in relation to the sale and purchase of our products.
21. law and jurisdiction
21.1 These Terms and Conditions shall be governed by and construed in accordance with Irish law. Any disputes relating to these Terms and Conditions shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.21.2 If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms and Conditions, including the paragraph above, affects your rights as a consumer to rely on such mandatory provisions of local law.
